I have laid before the Lords Commissioners of His

Majesty's Treasury Mr. Calder's letter of the 6th ultimo (13758/33) relative to the question of the reference of the Hong Kong piracy case, Rex v. Chung Tam Kwong and others, to the Judicial Committee of the Privy Council under Section 4 of the Judicial Committee Act 1833.

In reply I am directed to request you to inform the Secretary of state that, if His Majesty should think fit so to direct, my Loras agree that the reference may proceed, provided that half of the costs of the reference is borne by the Government of Hong kong.

A copy of this letter has been sent to the Treasury Solicitor, to the Admiralty and to the Board of

Trade.
